Penalties for driving without a valid license in New York

New York traffic law can be a complicated thing for driver’s to understand and keep track of. There are many different types of violations and consequences and some even involve criminal charges. One of the penalties that drivers can face depending upon the situation is the loss of driving privileges. This can include either a suspension or a full revocation of a driver’s license.

It is easier than many people may think to be in this situation. Some drivers may even be completely unaware that they have a suspended driver’s license or a revoked driver’s license. If you are stopped for any reason by a police officer and found to be operating a vehicle with a revoked or suspended license, criminal charges can be filed against you. The charge will be for an AUO or Aggravated Unlicensed Operation in full.

A second or third degree AUO charge is a misdemeanor while a first degree AUO charge is a felony. If you are convicted of the latter, you can spend time in a state prison and be forced to pay fines up to $5,000 in addition to other surcharges. You can check the status of your driver’s license on the New York Department of Motor Vehicle website. You can also see if you have any points on your license. Doing this is always a good idea to avoid unnecessary surprises that could pose serious problems for you.
