Man faces suspended license in two states after DWI conviction

Drivers in New York can be cited for and convicted of drunk driving even if they hold drivers’ licenses in other states. Any driver must obey the local laws when driving in New York and may be subject to the same penalties as residents of the state. This can include a suspended driver’s license, fines, jail time and more.

According to recent news reports, a recent conviction and sentencing in a Long Island municipal court has applied such penalties to a South Carolina driver. The man is a former State Treasurer in South Carolina and according to the Department of Motor Vehicles in South Carolina he will actually face consequence in that state as well as in New York for his DWI conviction.

He was stopped in the early morning hours in July 2013 when an officer noticed him crossing street marker lines. His blood alcohol content at the time of his arrest was just slightly above the legal limit at 0.09 percent. The defendant will have a suspended license for a period of six month in both states. After that time, he will be required to utilize an ignition interlock device any time he drives in New York for another 12 months. The ignition interlock device will not be required in South Carolina.

Any driver who faces the possibility of a suspended license and related penalties for any traffic violation may wish to consult with an attorney. Getting help with a defense can potentially reduce the impact to defendants.
