What are New York’s penalties for speeding violations?

Most people in New York are aware of the increased oversight on speeding throughout the greater New York City area in the past year or so. With the mayor’s Vision Zero plan securely in place, this is not likely to change any time soon. At Martin A. Kron and Associates, we have worked with many drivers facing serious penalties for speeding tickets or other violations, and we help people understand the potential consequences for such convictions.

Speeding violations are generally treated as misdemeanors in New York. A single ticket conviction can result in between three and 11 points being added to a person’s driving record with the DMV. The number of points relates directly to the speed for which a ticket was written. Eleven points are assessed for people found guilty of driving more than 40 miles per hour over the posted speed limit. 

Point assessment for other speeds includes:

  • Eight points for speeds 31 to 40 miles over the limit
  • Six points for speeds 21 to 30 miles over the limit
  • Four points for speeds 11 to 20 miles over the limit
  • Three points for speeds up to 10 miles over the limit or otherwise deemed unreasonable

A charge of reckless driving, which may or may not be related only to speeding, can result in five points being added to a driving record.

Depending upon other circumstances which may be involved, drivers can also be forced to pay fines including a driver’s responsibility assessment fee to the DMV as well as insurance surcharges. Some speeding ticket violations can also lead to jail time for convicted defendants.
