You have a right to a defense for traffic violations

When you're driving in New York City, one thing you have to constantly be aware of is the traffic. There is not a moment that goes by when there aren't other vehicles on the roads.

The roads can be congested, and that sometimes makes them hard to deal with. However, you still have the obligation to drive as safely as you can.

If you become distracted or fail to stop for a traffic light or stop sign, you may end up with a traffic violation. If you receive a ticket for the failure to stop at a stop sign or traffic light, it's a noncriminal offense and will be handled by the Traffic Violation Bureau. New York City has two departments, one for traffic violations and another for criminal violations. The courts do no hear noncriminal cases, so that the judges are available for more serious crimes.

What should you know about getting a traffic violation in New York?

One thing to know is that you don't have to accept the ticket and pay it right away. You have a right to plead not guilty to a traffic ticket. If you decide to do that, then an Administrative Law judge with the DMV will hear your case and decide if you are guilty or not. If you are found guilty, you will have a fine set. The judge also has the right to suspend or revoke your license, so it pays to be attentive and respectful when you're in court. Remember that you have a right to be represented by your attorney when you attend your hearing.
