New York’s Seat Belt Law: VTL 1229-c
New York enacted the nation’s first mandatory seat belt law in 1984. VTL 1229-c now requires all drivers and passengers to be properly restrained. As of November 1, 2020, that requirement extends to all passengers age 16 and older regardless of seating position. A 2024 amendment, effective April 21, 2025, added charter bus passengers age 8 and older under a new subdivision of 1229-c.
New York is a primary enforcement state, meaning a law enforcement officer may stop and ticket a driver solely for a seat belt violation without needing another reason for the stop. Drivers are also responsible for ensuring that all passengers under age 16 are properly restrained, wherever those passengers are seated.
Fines, Points, & the Driver Responsibility Assessment
The financial consequences depend on who was unrestrained. For an adult driver or passenger violation, the fine is up to $50 plus a mandatory $93 state surcharge, with no DMV points assessed. When a passenger under age 16 is improperly restrained, the driver faces up to $100 plus a $93 surcharge and 3 points per violation on their license. A separate ticket can be issued for each child found out of compliance.
The point consequences matter beyond the license. Here’s what the numbers can trigger:
- Reaching 6 or more points within 18 months activates the New York Driver Responsibility Assessment (DRA), adding fees on top of any court fines
- Reaching 11 or more points within 18 months can result in license suspension
- Even a zero-point seat belt conviction appears on your driving abstract and can trigger a premium surcharge under your insurer’s merit rating system
When a seat belt ticket arrives alongside a speeding or other moving violation, point totals can climb quickly. That’s when a single ticket stops looking minor.
How the Court Process Works in New York
Where your ticket is heard determines your options. In New York City, seat belt cases go before the Traffic Violations Bureau (TVB), which doesn’t permit plea bargaining. The only path at the TVB is to contest the officer’s evidence directly at a hearing. Outside New York City, seat belt tickets are handled in local town and village courts, where negotiated reductions are available in many cases.
