New York’s Seat Belt Law: VTL 1229-c

New York enacted the nation’s first mandatory seat belt law in 1984. VTL 1229-c now requires all drivers and passengers to be properly restrained. As of November 1, 2020, that requirement extends to all passengers age 16 and older regardless of seating position. A 2024 amendment, effective April 21, 2025, added charter bus passengers age 8 and older under a new subdivision of 1229-c.

New York is a primary enforcement state, meaning a law enforcement officer may stop and ticket a driver solely for a seat belt violation without needing another reason for the stop. Drivers are also responsible for ensuring that all passengers under age 16 are properly restrained, wherever those passengers are seated.

Fines, Points, & the Driver Responsibility Assessment

The financial consequences depend on who was unrestrained. For an adult driver or passenger violation, the fine is up to $50 plus a mandatory $93 state surcharge, with no DMV points assessed. When a passenger under age 16 is improperly restrained, the driver faces up to $100 plus a $93 surcharge and 3 points per violation on their license. A separate ticket can be issued for each child found out of compliance.

The point consequences matter beyond the license. Here’s what the numbers can trigger:

Reaching 6 or more points within 18 months activates the New York Driver Responsibility Assessment (DRA), adding fees on top of any court fines
Reaching 11 or more points within 18 months can result in license suspension
Even a zero-point seat belt conviction appears on your driving abstract and can trigger a premium surcharge under your insurer’s merit rating system

How the Court Process Works in New York

Where your ticket is heard determines your options. In New York City, seat belt cases go before the Traffic Violations Bureau (TVB), which doesn’t permit plea bargaining. The only path at the TVB is to contest the officer’s evidence directly at a hearing. Outside New York City, seat belt tickets are handled in local town and village courts, where negotiated reductions are available in many cases.

Defenses & Exemptions to New York Seat Belt Violations

A seat belt ticket isn’t automatically a conviction. The officer who issued the summons bears the burden of establishing specific facts at a hearing: how the observation was made, whether the vehicle was in motion, and in child-restraint cases, how the officer determined the age of the passenger. If those specifics are vague or inconsistent, the case may be subject to dismissal.

Defense strategies typically focus on whether the officer had a clear, unobstructed line of sight; whether the ticket itself contains documentation errors; and, where a driver was actually in compliance, presenting witness statements or physical evidence of functioning seat belt equipment.

Recognized exemptions under New York law:

Passengers in emergency vehicles
Occupants of vehicles manufactured in 1964 or earlier that were not originally equipped with seat belts
Passengers on city buses (not school buses)
Individuals with a qualifying medical condition, documented in writing by a physician on the physician’s letterhead

Child Restraint Requirements Under 1229-c

The child restraint rules under New York law are age- and weight-based, and an officer can issue a ticket even when a child is restrained if the restraint system doesn’t meet the specifications for that child’s size.

The current requirements are:

Under age 2: Rear-facing car seat
Under age 4: Child safety seat appropriate for height and weight; children under 4 who weigh more than 40 pounds may use a booster seat with a lap and shoulder belt
Ages 4 through 7: Booster seat with a lap and shoulder belt, or an approved child safety seat
Ages 8 through 15: Standard seat belt in any seating position

Because a driver can receive a separate ticket for each child found to be improperly restrained, each carrying its own fine and 3-point assessment, a single traffic stop can create significant exposure when multiple children are in the vehicle. Understanding how an officer determines whether a restraint meets specifications is central to contesting these tickets.

How a Seat Belt Conviction Affects Your Insurance

Insurance companies operate their own merit rating systems, separate from the DMV point system. A seat belt conviction can trigger a surcharge under your policy even when no DMV points are assessed. Insurers typically review your driving abstract for the prior three years when calculating premium rates, and any conviction found in that window can produce a surcharge that persists long after.

A traffic conviction generally remains on your DMV record for the year it occurred plus three additional calendar years. Over a multi-year policy cycle, a single seat belt conviction can cost substantially more than the original fine. Contesting the ticket rather than paying it is often a more cost-effective decision once the long-term insurance impact is factored in.
