Two Types of Red Light Tickets in New York

Not every red light ticket works the same way, and the distinction matters for how your case is handled.

Officer-Issued Moving Violations

When a police officer issues a red light ticket, it’s a moving violation under VTL 1111(d)(1) for failing to stop at a red signal. In New York City, these cases are heard at the DMV Traffic Violations Bureau (TVB), where an administrative law judge rules guilty or not guilty after a hearing. There is no plea bargaining at the TVB. Outside the city, red light tickets go to local town, village, or city courts where a prosecutor may negotiate a reduced charge.

Red Light Camera Civil Notices

Camera violations operate under a different law entirely. NYC’s red light camera program issues civil notices under VTL 1111-a to the vehicle’s registered owner, regardless of who was actually driving. Because the camera captures only a license plate, the ticket follows the vehicle, not the driver. These notices are adjudicated through the NYC Department of Finance, not the TVB, which creates a distinct set of defenses and a separate hearing process.

Penalties for a Red Light Violation in New York

The financial and record consequences depend heavily on which type of ticket you received.

Officer-Issued Tickets under VTL 1111(d)(1)
A conviction can carry a maximum fine of $450, a surcharge of up to $85, and 3 points on your driver’s license. The potential for up to 15 days in jail exists under the statute, though it’s rarely imposed. What compounds quickly is the downstream impact: accumulate 6 or more points within 18 months and the New York Driver Responsibility Assessment (DRA) kicks in, an additional annual fee paid to the DMV over three years. Reach 11 or more points within 18 months and your license may be suspended. A conviction stays on your record for the year of conviction plus three more years, which is the window insurers typically review when adjusting premiums.

Red Light Camera Violations
The fine is a flat $50. If you don’t respond within 30 days, a $25 late penalty is added. No DMV points are assessed, and no surcharge applies. Ignoring the notice entirely, however, can lead to a registration hold, referral to a collections agency, or a default judgment. Five or more camera violations within a 12-month period can also trigger a requirement to complete a safe driving course, with vehicle impoundment as a possible consequence for non-compliance.
