Red Light Ticket Lawyer in New York
Defense From a Former New York Traffic Court Judge
A red light ticket can look like a minor fine until you see what follows: points on your license, a surcharge, higher insurance premiums, and potential DMV consequences if those points accumulate. Whether you’ve been pulled over by an officer or received a camera notice in the mail, the decision to contest or pay has real consequences for your record and your wallet. At Martin A. Kron & Associates, P.C., our practice is led by Martin A. Kron, a former New York State Traffic Court Judge trained by the DMV who presided over thousands of trials involving the Vehicle and Traffic Law. That background shapes how we approach every case.
Pleading guilty means accepting the result. Contesting creates options.
Our firm offers free consultations by phone, and in most cases our attorneys appear on your behalf so you don’t have to take time off work or show up in court. Call (212) 235-1525 to discuss your ticket before the response deadline passes.
Two Types of Red Light Tickets in New York
Not every red light ticket works the same way, and the distinction matters for how your case is handled.
Officer-Issued Moving Violations
When a police officer issues a red light ticket, it’s a moving violation under VTL 1111(d)(1) for failing to stop at a red signal. In New York City, these cases are heard at the DMV Traffic Violations Bureau (TVB), where an administrative law judge rules guilty or not guilty after a hearing. There is no plea bargaining at the TVB. Outside the city, red light tickets go to local town, village, or city courts where a prosecutor may negotiate a reduced charge.
Red Light Camera Civil Notices
Camera violations operate under a different law entirely. NYC’s red light camera program issues civil notices under VTL 1111-a to the vehicle’s registered owner, regardless of who was actually driving. Because the camera captures only a license plate, the ticket follows the vehicle, not the driver. These notices are adjudicated through the NYC Department of Finance, not the TVB, which creates a distinct set of defenses and a separate hearing process.
Penalties for a Red Light Violation in New York
The financial and record consequences depend heavily on which type of ticket you received.
Officer-Issued Tickets under VTL 1111(d)(1)
A conviction can carry a maximum fine of $450, a surcharge of up to $85, and 3 points on your driver’s license. The potential for up to 15 days in jail exists under the statute, though it’s rarely imposed. What compounds quickly is the downstream impact: accumulate 6 or more points within 18 months and the New York Driver Responsibility Assessment (DRA) kicks in, an additional annual fee paid to the DMV over three years. Reach 11 or more points within 18 months and your license may be suspended. A conviction stays on your record for the year of conviction plus three more years, which is the window insurers typically review when adjusting premiums.
Red Light Camera Violations
The fine is a flat $50. If you don’t respond within 30 days, a $25 late penalty is added. No DMV points are assessed, and no surcharge applies. Ignoring the notice entirely, however, can lead to a registration hold, referral to a collections agency, or a default judgment. Five or more camera violations within a 12-month period can also trigger a requirement to complete a safe driving course, with vehicle impoundment as a possible consequence for non-compliance.
Why Martin A. Kron & Associates, P.C. for Red Light Ticket Defense
Martin A. Kron is a former New York State Traffic Court Judge who presided over thousands of cases involving the Vehicle and Traffic Law and NYC Traffic Regulations, including red light violations. He knows how administrative law judges evaluate officer testimony and camera evidence because he evaluated it himself. That perspective, applied across more than 100,000 traffic cases in New York and New Jersey over more than 40 years, is central to how we approach these cases.
We provide one-on-one attention to every client and honest assessments of what’s realistic in your case. We don’t promise outcomes we can’t guarantee. What we do is prepare your case thoroughly and pursue the best available result at your TVB or Department of Finance hearing. In most situations, you won’t need to appear at all.
Don’t Let the Deadline Decide Your Case
A red light ticket in New York comes with a response deadline. Miss it and your options narrow, penalties grow, and a default finding can go on your record without a hearing. Calling us early preserves every available avenue to fight the charge.
Free phone consultations are available at your convenience, and we can begin working on your case as soon as you call. Reach Martin A. Kron & Associates, P.C. at (212) 235-1525.

"It's a relief knowing they are on my side."
I am currently a client of Martin and his firm. They are a hard working firm and have been a pleasure to work with. I have spoken to several of them on the phone (sometimes on the weekend) and they have been nothing short of kind and generous. Their feedback and guidance thru emails and phone calls have been outstanding. It's a relief knowing they are on my side and doing everything they can to restore my driving privileges. Their attention to detail and enthusiasm in helping me is unlike no other firm I have dealt with. I would highly recommend them if you are in any sort of traffic violations.

"Mr. Kron is wonderful!"Mr. Martin A. Kron is a knowledgeable, professional, effective and caring Attorney. And finding this combination is very rare. He treats you like a client, but he also treats you like family. I have gotten speeding tickets in the past and handled them myself. But this was a DWI Ticket (and a careless driving ticket) and I was petrified. I found Mr. Martin Kron, and he was wonderful. He believed what I had to say, he walked me through the process, and he even gave me his cell number and home email so that I could contact him any time I felt scared or confused. The first court date was just to enter the plea. Mr. Kron spoke with the Prosecutor prior to the second court appearance and we were hoping that based on the evidence, the Prosecutor would dismiss the tickets. No such luck. I think the Prosecutor wanted another "win" in his column, and I was going to be it. Mr. Kron presented our case and the Prosecutor presented why he had grounds to proceed to trial. But Mr. Kron professionally stood his ground and the 2 tickets were dismissed that day! I couldn't more highly recommend an attorney! Mr. Kron is wonderful!Eileen

"The judges in the courts we were in knew who he was and liked him."Martin Kron and his office did a wonderful job helping me with traffic tickets that were more than 3 years old!!! The judges in the courts we were in knew who he was and liked him and his professionalism. His associates in his office were very very nice, timely and helpful. He was always reachable and actually made the experiment fun... I was worried I would have to pay high fines because I had not done anything about these tickets for so many years, but because of Martin and his relationships with the courts, I really got great fines with no points added to my license!!! I forwarded his information to several of my friends because we finished so quickly. I would refer him again at any time.Darra
