Two Types of Red Light Tickets in New York

Not every red light ticket works the same way, and the distinction matters for how your case is handled.

Officer-Issued Moving Violations

When a police officer issues a red light ticket, it’s a moving violation under VTL 1111(d)(1) for failing to stop at a red signal. In New York City, these cases are heard at the DMV Traffic Violations Bureau (TVB), where an administrative law judge rules guilty or not guilty after a hearing. There is no plea bargaining at the TVB. Outside the city, red light tickets go to local town, village, or city courts where a prosecutor may negotiate a reduced charge.

Red Light Camera Civil Notices

Camera violations operate under a different law entirely. NYC’s red light camera program issues civil notices under VTL 1111-a to the vehicle’s registered owner, regardless of who was actually driving. Because the camera captures only a license plate, the ticket follows the vehicle, not the driver. These notices are adjudicated through the NYC Department of Finance, not the TVB, which creates a distinct set of defenses and a separate hearing process.

Penalties for a Red Light Violation in New York

The financial and record consequences depend heavily on which type of ticket you received.

Officer-Issued Tickets under VTL 1111(d)(1)
A conviction can carry a maximum fine of $450, a surcharge of up to $85, and 3 points on your driver’s license. The potential for up to 15 days in jail exists under the statute, though it’s rarely imposed. What compounds quickly is the downstream impact: accumulate 6 or more points within 18 months and the New York Driver Responsibility Assessment (DRA) kicks in, an additional annual fee paid to the DMV over three years. Reach 11 or more points within 18 months and your license may be suspended. A conviction stays on your record for the year of conviction plus three more years, which is the window insurers typically review when adjusting premiums.

Red Light Camera Violations
The fine is a flat $50. If you don’t respond within 30 days, a $25 late penalty is added. No DMV points are assessed, and no surcharge applies. Ignoring the notice entirely, however, can lead to a registration hold, referral to a collections agency, or a default judgment. Five or more camera violations within a 12-month period can also trigger a requirement to complete a safe driving course, with vehicle impoundment as a possible consequence for non-compliance.

How Red Light Ticket Hearings Work in New York

The hearing process differs depending on whether your ticket was issued by an officer or a camera, and understanding that difference helps clarify what contesting actually involves.

TVB Hearings for Officer-Issued Tickets

In New York City, officer-issued red light tickets are decided at the DMV Traffic Violations Bureau. An administrative law judge presides, the officer testifies, and the case is resolved as guilty or not guilty. There is no negotiation, no reduced plea, and no adjournment in contemplation of dismissal. The outcome depends entirely on the evidence and the quality of the defense presented at the hearing. Outside NYC, local courts may allow a prosecutor to negotiate a reduced charge, which can lower or eliminate points.

Department of Finance Hearings for Camera Tickets

Camera violation hearings are handled by the NYC Department of Finance, not the TVB. A Judicial Hearing Officer reviews the camera footage and hears the registered owner’s rebuttal. The result is either a violation or no violation finding, with no option to reduce the fine in exchange for a guilty plea. A response is due within 30 days of the notice date; missing that window adds the $25 late penalty and starts the escalation toward registration holds and collections.

Defense Strategies for Red Light Tickets

The right defense depends on the type of ticket and the specific facts of the stop or camera capture. Here are the primary challenges we evaluate for each.

Officer-issued ticket defenses:

Obstructed or unclear view: The officer’s position and sight lines at the time of the alleged violation are subject to challenge.
Signal malfunction or short cycle: A malfunctioning light or unusually brief signal cycle can undermine the officer’s account.
Entered on yellow: A driver who entered the intersection on a yellow light and couldn’t safely stop before it changed may have a viable defense.
Mechanical failure: Brake failure that prevented stopping in time is a recognized defense.
Emergency avoidance: Proceeding through a red light to avoid a collision with another vehicle or hazard.

Red light camera defenses:

Calibration and signage: Camera equipment must be properly calibrated, and required intersection signage must be in place; failure on either point can support a challenge.
Vehicle not in owner’s possession: If the vehicle was stolen prior to the violation or was no longer owned by you at the time, the registered owner may not be liable.
Misidentified vehicle or plate: If the vehicle or license plate shown in the camera image doesn’t match your vehicle, that discrepancy can support a challenge.
