The prosecution must establish that the accused operated a motor vehicle in a manner that unreasonably interfered with the free and proper use of a public highway or unreasonably endangered highway users. VTL § 1212 doesn’t set a universal speed threshold that automatically establishes reckless driving. The alleged conduct and surrounding circumstances matter.
Facts that can affect how the allegation is evaluated include:
