What Qualifies As a Speed Contest Under VTL § 1182?

VTL § 1182 prohibits engaging in, aiding, or abetting an unauthorized race, speed contest, or exhibition of speed on a highway.

An unlawful speed contest requires evidence of a planned race or an implied agreement between participants. Driving fast near another vehicle isn’t enough by itself to establish that agreement. Conduct that could support a speeding or reckless driving allegation doesn’t automatically prove a violation of VTL § 1182.

We examine the circumstances surrounding the alleged event and challenge whether the evidence shows coordinated conduct or merely two vehicles traveling at speed near one another.

Criminal & DMV Consequences of a VTL § 1182 Conviction

A VTL § 1182 violation is a misdemeanor rather than an ordinary traffic infraction. Its criminal penalties depend in part on whether the driver has a qualifying prior conviction.

Potential consequences include:

First conviction: Up to 30 days in jail, a fine from $300 to $525, or both.
Second conviction within 12 months: Up to six months in jail, a fine from $525 to $750, or both.
Violations on or after February 16, 2026: Five DMV points based on the violation date.
Persistent-violator review: Effective February 16, 2026, the DMV uses a 24-month look-back period for persistent-violator administrative action.

The criminal court sentence and DMV consequences are separate. The court addresses the misdemeanor charge, while the DMV applies points and reviews the driver’s record under its administrative rules.

Related Charges & Defense Issues

A VTL § 1182 charge can be accompanied by other alleged traffic offenses. We assess each allegation independently because each can affect the available defense and plea-negotiation strategy.

Reckless driving under VTL § 1212 is a separate misdemeanor. It applies to conduct that unreasonably interferes with the free and proper use of a public highway or unreasonably endangers its users. A first conviction for that offense carries up to 30 days in jail, a fine of up to $300, and five DMV points.

We examine whether the prosecution can establish an agreement to race and whether the evidence supports each related charge. When the facts and procedural posture permit, we may negotiate to limit the charge or license points, but no result can be promised.
