Where Brooklyn Suspended-License Cases Are Decided

The Traffic Violations Bureau, a DMV division, processes non-criminal moving violations in the five boroughs. Third-degree AUO (misdemeanor): A first violation of driving with a suspended or revoked license

Why Licenses Get Suspended in New York

Suspensions in New York arise from a range of triggers, not all of them obvious. Knowing the source of a suspension matters because the path to reinstatement depends entirely on what caused it.

Common suspension triggers include:

Point accumulation: Accruing 11 or more points within any 18-month period can result in suspension under the DMV point system
Unanswered tickets or missed court dates: Failure to respond to a traffic ticket or appear at a required hearing triggers an automatic suspension
Alcohol or drug-related violations: A driving while ability impaired (DWAI) conviction or a refusal to submit to a chemical test can both lead to suspension
Insurance lapse: A gap in auto insurance coverage can result in suspension of both the vehicle’s registration and the driver’s license
Non-traffic triggers: Unpaid child support, certain unpaid taxes, or failure to file a required accident report can all produce an indefinite suspension until the underlying issue is resolved

Definite vs. Indefinite Suspensions & Reinstatement in New York

New York suspensions fall into two categories. A definite suspension carries a fixed end date; it can’t be lifted early, and reinstatement requires waiting out the full term and paying a suspension termination fee. An indefinite suspension has no set end date and lifts only when the driver completes a specific required action, such as answering an outstanding ticket, paying a fine, or filing an overdue crash report.

Reinstatement generally involves paying all outstanding fines and fees, completing any court-ordered programs or classes, submitting proof that required conditions have been met, and filing a restoration request with current proof of insurance. The specific steps vary based on the reason for suspension, which is why identifying the correct trigger from the outset saves time and avoids missteps.

Conditional & Restricted-Use Licenses

Some drivers facing a suspension have access to limited driving privileges while their full license is unavailable. A restricted use license permits driving for defined purposes: commuting to work or school, attending medical appointments, and childcare-related travel. A conditional license is generally available to drivers who enroll in New York’s Impaired Driver Program following an alcohol- or drug-related suspension.

Both options come with strict terms. Violating those terms is itself a criminal offense and can result in a total loss of driving privileges. Understanding exactly what you’re permitted to do under either license before you get behind the wheel isn’t optional.

New York’s Driver’s License Suspension Reform Act

Effective June 29, 2021, the Driver’s License Suspension Reform Act changed how New York handles suspensions tied to unpaid tickets and missed hearings. The law ended license suspensions for nonpayment of traffic tickets and for failing to appear at a traffic hearing, and it reinstated licenses that had been suspended solely for those reasons.

The Act also extended the failure-to-appear window from 30 days to 90 days before suspension takes effect, giving drivers more time to respond. And it made income-based payment plans available for traffic debt, reducing the financial pressure that often led to ignored tickets.
