The Traffic Violations Bureau, a DMV division, processes non-criminal moving violations in the five boroughs. But once a driver is charged with operating on a suspended license, the case typically moves into the criminal system under Vehicle and Traffic Law Section 511, which defines aggravated unlicensed operation (AUO).
Kings County Criminal Court has jurisdiction over misdemeanor and felony cases arising in Brooklyn, and that’s where most AUO charges land. The degree of the charge depends on the circumstances:
- Third-degree AUO (misdemeanor): A first violation of driving with a suspended or revoked license
- Second-degree AUO (misdemeanor): Applies when there’s a prior AUO conviction, a suspension for refusing a chemical test, a suspension pending DWI prosecution, or three or more suspensions on separate dates
- First-degree AUO (Class E felony): Effective November 1, 2024, Angelica’s Law elevated this charge for drivers with five or more suspensions or revocations imposed on at least five separate dates

He spoke to the prosecutor and as indicated in the title, cut the points on my two tickets from 8 to 2, reduced my fines by a third, and we were out of court in 45 minutes. Mr. Kron and I deferred our case 4 times which is the maximum.
